Rebecca Capel claimed shares nos.62,63,64,120,146, will of George Capel.
Mr Ford stated that if Committee allowed excavations and mason’s works at Eastington Pike Lock and Blunder Lock to be done by his servants, he would bear the expense and undertake that the canal should not be stopped for more than three days, under penalty of £5 for every day stopped. Work to be commenced at next neap tide. Subject referred to General Meeting
At a Meeting of the Committee of the Stroudwater Navigation held at the Committee Room at Wallbridge on Tuesday the 26^th day of April 1859
Present: M^r F Eycott, M^r Cha^s Hawker Chairman, J H Warman, Cha^s Hooper, N S Marling, H H Wilton. G H A Beard, H Harris.
The various Accounts Books and Vouchers signed by M^r Cooper the Auditor and certified to be corrected were produced & examined.
The Treasurer's Book was produced examined and signed.
M^r Charles Hawker of Spellman's Court in the Parish of Rodborough in the County of Gloucester attended on behalf of Rebecca Capel of Cheltenham in the aforesaid County Widow and made out the Claim of the said Rebecca Capel to Six Shares N^os 7, 62, 63, 64, 120 & 146 of the Undertaking of the Stroudwater Navigation as sole Executrix & residuary Legatee of George Capel late of Cheltenham in the aforesaid County and now standing in the name of the said George Capel deceased in the books of the Company of Proprietors of the Stroudwater Navigation by producing the Probate of the Will of the said G Capel deceased bearing date the 26^th day of May 1847 and proved in her Majesty's Court of Probate for the District of Gloucester on the 24^th day of February 1859 by the said Rebecca Capel Widow of the deceased & Sole Executrix and also by producing the said Tickets or Titles to the said Shared and the Claim was admitted accordingly & new Tickets ordered to be made out.
M^r Ford attended the Committee and stated that if the Committee were willing to allow the excavations and Masons works at Eastington Pike Lock and the Blunder Lock, which he pointed out the the Deputation on the 22^nd February last. with a view to allowing the Steam Vessel "Queen Esther" to come up the canal as far as Ryeford Mill, to be done by his Servants under the superintendence and to the satisfaction of the Company's Surveyor, he would bear all the expense and undertake that the Canal should not be stopped for more than three days, under a penalty of Five pounds for Every day it maybe stopped after that time, the work to be commenced at the next Neap Tide. Ordered that the subject be referred to the General Meeting.
