Tue 16 Sep 1884
Chairman had met Mr Davies Junior, viewed the fields, and did not consider that Mr Davies Senior had any right of use over the towing path. It was obvious that the two pieces were severed as a result of the making of the Stonehouse and Nailsworth Railway when compensation would have been awarded to Mr Davies for the severance. It was agreed that the towing path could not be used to get to both fields without the tenant entering into an agreement similar to the 1878 agreement with Mr Fawkes and that Mr Davies should be sent a copy of this minute and should be urged to enter into such an agreement.
Clerk reported that when the new gates at Dudbridge were put in, the Night Watchman, Edward Hill, was in bed and not on watch. Mr Hill, being in attendance at this meeting, was reprimanded and cautioned against a repetition of such gross neglect of duty.
Ordered that re-planking of the swing bridge at Stonehouse should be carried out.
Committee Meeting held at Wallbridge on Tuesday the 16^th day of September 1884 @ 3,o,clock pm
Present: Mr E C Little Chairman, Mr H H Mills, Mr E F Gyde, Mr A J M Ball, Mr G H A Beard,, Sir W H Marling.
[45] Ordered that the next Committee Meeting be held on Tuesday the 21^st day of October next @ 3,o,clock pm and the General Half-Yearly Meeting on the same day at 4,o,clock pm.
[51] The Chairman stated that he had viewed with Mr Davies junr the tow pieces of ground or fields referred to in the Minutes of the last Meeting and that he (the Chairman) did not consider Mr Davies Senr as the owner of such pieces of ground or fields had any right of user whatever over the towing path, inasmuch as it was evident the two pieces were severed upon the making of the Stonehouse and Nailsworth Railway when Compensation would in in the usual order of things have been awarded to Mr Davies for the severance.
It was therefore resolved that no recognition of Mr Davies' alleged right of communication between the two pieces of ground or fields by means of the Towing path should be made or such communication permitted without an agreement similar to the effect to the one entered into on the 11^th May 1878 by William Fawkes the then tenant of Mr Davies, but the Committee instructed their Clerk to propose to Mr Davies the entering into of such an agreement by him and to forward him a copy of this Minute.
[7] The Clerk reported that during the putting in of the New Gates at Dudbridge Lock he found the night watchman (E^d Hill) in bed instead of on Watch and his attendance at this meeting having been required by the Clerk and being in attendance he was reprimanded by the Committee and cautioned against a repetition of such gross neglect of duty.
[4] The Clerk also reported that the Swing Bridge at the Ocean (Stonehouse) required re-planking and this was ordered to be done.
