I have discussed your letter with my Committee and would not object to taking the opinion of Counsel provided we can agree on a case to be submitted to him. However as his opinion would not be conclusive we would prefer that the position between the two canals should be laid before the Railway and Canal Commissioners to obtain an authoritative decision.

I have discussed your letter of the 11^th inst with my Committee who see no objection to the course you propose of taking the opinion of Counsel assuming that we agree on a case to be submitted to him but as this opinion cannot be actually conclusive we should much prefer that the whole position of the two Cos should be laid before the Railway & Canal Commissioners with a view to obtaining an authoritative decision upon all matters open between us.
