At a Special Meeting of the Committee held at the Committee Room at Walbridge on Thursday the 29^th Day of October 1840
Present: M^r Cosham, M^r Jos^h Fisher, M^r Jn^o Stanton, M^r Wyatt, M^R S Fisher, M^r Hughes, M^r Beard.
Having taken into consideration the Order of the last General Half Yearly meeting relative to the weight of a Bushel of Wheat carried on the Canal, it appears desirable for the interest of the Company to suspend the carrying the same in effect until the next General Meeting: and it is
Ordered that the Clerk do charge the Tonnage on wheat as heretofore, without altering the same; and that the Resolution above referred to be suspended until the next General Meeting accordingly.
Ordered that our Clerk do stop the Towing path of the Canal in various lengths, on the following days, by stationing men at various points thereof, - and such other means as shall be thought desirable so as to prevent the public from passing on the Towing path, in parts thereof on which there is no public footpath, for the purpose of preserving the exclusive right of the Company to the same Towing path, - and that the stoppage shall commence on Monday the 9th of November next, of which public notice shall be given by Hand bills.
Having taken into consideration the Resolution of the last General half yearly meeting respecting the breaking off the Lock of the flood gates near the Feeder at Lodgemore, and the enforcing the penalty for such offences, and having ascertained that the same was done by one Daniel Knight, our Clerk M^r Mason was instructed to wait on M^r Hunt, the master of the said Daniel Knight on the subject, when M^r Mason reported that he had waited on M^R Hunt, and in the interview with him he (M^r Hunt) disclaimed all participation in the act of the said Daniel Knight, and all authority form him for so doing, & stated that he had dismissed the man from his Service. M^r Mason then asked him whether he wished to interfere in the man's behalf to prevent his being prosecuted for the act; When he said he did not as he had discharged him. Then M^r Mason remarked that it would be the Company's resolution to prosecute him in order to prevent the repetition of the offence, if it were likely to be repeated, when M^r Hunt permitted him to understand that the act would not be again repeated, by any Servant of his.
Ordered that under these circumstances it is not expedient to proceed against the Millman at present.
The Wall belonging the Garden of the House of M^r John Fred Lewis of Ebley along the side of the Canal lying between the House and the Bridge there, being in a dangerous State and likely to fall, to the obstruction of the Towing path:_
Ordered that our Clerk do give him notice to provide for the same, or that in case the apprehended Event shall happen he will be held responsible for any damages which may arise to the Company therefrom; and also to desire that it be built further from the Canal.
