Report of third meeting of Commissioners,
Stroud 9th September 1779
We whose names are hereunto subscribed being Commissioners appointed and nominated in and by an Act of Parliament passed in the sixteenth year of the reign of His Majesty King George the Third intituled "An Act to amend an Act passed in the third year of his late Majesty's reign intituled An Act for making navigable the River Stroudwater in the County of Gloucester from the River Severn at or near Framiload to Wallbridge near the Town of Stroud in the same county; and for giving other powers for the purpose of making a navigation from Framiload to Wallbridge aforesaid being mett at the dwelling house of William Turner known by the George Inn in the town of Stroud aforesaid in pursuance of our last adjournment and an advertisement in the Gloucester Journal of the 30th of August last do come to the following resolution viz:
We do order ascertain and determine that the sum of One Pound and One Shilling shall be imediately paid by the Company of Proprietors of the Stroudwater Navigation to the Rev. Mr Willm. Davis for the damages occasioned by the flooding his lands in a piece of ground call'd Little Oldbury near Chippenhams Platt in the Parish of Eastington in the county of Gloucester which we do adjudge a full satisfaction for all damages sustained by such overflowing the said land and all injury done sum of Five Pounds for the Elm timber destroyed in making the said canal and towing path We do further order that the sum of Two pounds of acre be paid to the said Richard Stephens by the said Company of Proprietors for the damage he will have sustained in consequence of the earth and soil being thrown in the several lands of the said Richard Stephens of Ebley aforesaid by Michaelmas next And that the further sum of Twenty Shillings per Acre damages shall be paid to the said Richard Stephens from Michaelmas next to Michaelmas 1780 which said several sums when paid We do adjudge and determine to be a full satisfaction for all injurys and tresspases done to the said Richard Stephens land at Ebley aforesaid.
We do ascertain and determine the value of the orchard and rack hill belonging to Mr Holiday Phillip in the parish of Stonehouse in the said county of Gloucester for himself, and after his death to Mrs Mary Brown and Doctor Sandford to be Eighty Seven pounds and Ten shillings per Acre And we do ascertain and determine the value of the corner piece of arable land there, belonging to the said Mr Holiday Phillips to be Sixty Nine pounds which said several pieces we do order and direct shall be paid for so much thereof as the said Company of Proprietors shall take to for the purposes of the said navigation by the said Company of Proprietors into the hands in the names of Thomas Pettat Esq and Robert Sandford Esq the interest thereof to the said Holiday Phillips for his life and afterward to such person or persons as the said lands are limited by the will of the late __ Phillips deceased Uncle of the said Holiday Phillips. And the store to be valued by two persons one to be chosen by the said Holliday Phillips and the other by the said Company of Proprietors in which valuations the store is to be considered as a building intended to be take down.
We do order that the said Company of Proprietors do imediately pay to the said Holliday Phillips the sum of Twenty Shillings which we do adjudge to be in full satisfaction for all damages done to his racks and close called the Rack Hill aforesaid and we do order the said Company of Proprietors to raise the ground therein.
We do order that the said Company of Proprietors of the Stroudwater Navigation shall imediately pay to Mr Ellis James the sum of Two Pounds ten shillings per acre per annum for his meadows or pasture ground for two years damages he sustained at Lady Day last in his meadow or pasture ground in consequence of the earth and soil being thrown on his said lands by the said Company in the parish of Eastington in the County of Gloucester And the further sum of Two Pounds per acre per annum for the same lands from Lady Day last to Lady Day 1780 to be paid on on Lady Day 1780 And the further sum of One pound Ten shillings per annum per acre for thE same land from Lady Day 1780 to Lady Day 1781 to be paid on the said Lady Day 1781 And the further sum of Twenty shillings per annum per acre for the same land from Lady Day 1781 to Lady Day 1782 to be paid on the said Lady Day 1782 And we do further order that the said Company of Proprietors do imediately pay to the said Ellis James the sum of Twenty one Shilling per annum per acre for the Arable Land of the said Ellis James for two years Damages which he had sustained at Lady Day last in his said Arable Land in consequence of the Earth and Soil being thrown on his said Arable Lands by the said Company in the said Parish of Eastington And the further sum of Twenty shillings per annum per acre for the same arable lands from Lady Day last to Lady Day 1780 to be paid on the said Lady day 1780 And we do hereby further order that the sum of Eighteen pounds Seventeen shillings shall be paid by the said Company of Proprietors to the said Ellis James for all damages done to him on his said lands or grounds by trespass, making drains loss of crops or otherwise which said several sums when paid to the said Ellis James we do hereby adjudge and determine to be a full satisfaction for all injuries damages and tresspases done to the lands or grounds of or belonging to the said Ellis James.
We do ascertain and determine the value of an orchard at Cainscross belonging to John Butcher to be One Hundred and Five pounds per acre provided the quantity to be taken by the said Company of Proprietors from the lower part thereof for the use of a wharf do not exceed half an acre.
We do order that posts and rails pr a Quick fence be made by the said Company of Proprietors to seperate the towing path from the lands of Mr Ruddal occupied by Mr Nathanial Simpson.
