Summary

Subcommittee met Mr Sims and his solicitor at Framilode, who produced a conveyance from the Company to Mr Joseph Grazebrook about 1797, about land on which valve referred to as having been removed by Mr Sims was placed. As land was claimed and used by Mr Sims for upwards of 20 years, there was no substantial ground for insisting on restoration of culvert to the original state, especially as Mr Sims intended to resist to the uttermost the Company’s claim to have it done. The Committee approved the variation of the fence, giving greater breadth to towing path of the canal and allowed the culvert to remain as erected by Mr Sims on an agreement to allow the Company to have access to it at all times for the purpose of repairing it as with the old valve and culvert.

At a Meeting of the Committee of the Stroudwater Navigation held at the Committee Room at Wallbridge on Tuesday the 20^th day of January 1863
Present: M^r J H Warman, M^r H Harris Chairman, F Eycott, C H Fisher, G H A Beard, T M Croome, H H Wilton, C Hawker.
M^r Eycott, M^r Beard and M^r Fisher reported that they had attended again at Framilode in conformity with the Minute of the Committee Meeting of 18^th November last and met M^r Sims and his Solicitor, who produced a Conveyance from this Company to M^r Joseph Grazebrook in or about the year 1797 which from the description therein they considered comprised the land on which the Valve referred to in the Minutes as having been removed by M^r Sims was placed and finding also that this land had been claimed and used by M^r Sims for upwards of 20 years last past there appeared to them no substantial ground for insisting on the restoration of the Culvert to its original state as required by the Minutes especially as M^r Sims stated his intention to resist to the uttermost the Claim of the Company to have it done and they therefore agreed with M^r Sims (subject to the approval of the Committee) that a variation of the fence which was then and there pointed out, giving a greater breadth to the Towing path of the Canal, should be made and the Culvert allowed to remain as erected by M^r Sims on his entering into an Agreement to allow the Company to have access to it at all times for the purpose of repairing it in the same way they had with the old Valve and Culvert.
Resolved that the agreement so made by M^r Eycott M^r Beard and M^r Fisher is approved of and be carried out.
Ordered that a Subscription of £2 be given to the Stroud Coal Fund for the Poor this season.
