Minutes from 16 February 1831 to 23 October 1846
of the Committee of Proprietors of the Stroudwater Navigation
Messrs Fisher produced the case and opinion directed to be made on 13th July. Ordered that cases and opinions be collected and transcribed into a book.
Mr Charles Bosley complained of charges for warehousing goods at Dudbridge Wharf. Company expect Mr George to remove cause of complaint.
Half Yearly General Meeting. Tonnage £3508 10s 8d. Balance after wages, etc, £2830 8s 7d. Dividend of £14 declared.
Letter from Messrs Richard & Peter Smith suggesting removal of obstructions in the stream from the Ship to end of Wallbridge Wharf and to cut the bank straight. Brook to be inspected.
Every bushel of wheat to be counted as 60 pounds instead of 56 pounds.
New Byelaw that master, owner or person in charge of a boat which is empty, or has cargo not delivered in 48 hours of arrival, who shall remain opposite wharf for 2 hours after being requested to remove it, to be fined 20s and charged 5s for every hour they remain.
Towing path to be shut where not a public footpath.
Mr Hooper reported that a man working as Millman for Mr Hunt of Lodgemore Mills, broke off lock belonging to Navigation on paddles of feeder at Lodgemore across the Painswick Stream, and drew up paddles preventing water flowing into canal. Penalty or punishment to be inflicted.
All clerks to have their sureties inspected. Mr Mason to produce a surety.
Special Meeting. Ruling about weight of a bushel to be suspended until next general meeting.
Clerk to stop towing path during November in various lengths to preserve exclusive right of Company to it.
Daniel Knight broke off the lock off floodgates near feeder at Lodgemore. Mr Hunt, his master, did not wish to interfere to prevent him being prosecuted as he had discharged him. Not expedient to proceed against millman at present. Mr Hunt gave Mr Mason to understand act would not be repeated by any servant of his.
Wall of house of Mr John Fred Lewis at Ebley between house and bridge in dangerous state and likely to fall and obstruct tow path. Clerk to give notice that he is responsible for any damages. Wall to be built further from canal.
Special Meeting. Messrs Fisher resigned office of solicitor to Proprietors. Mr Wathen appointed solicitor.
Mr Samuel Stephens Marling enquired terms on which he could build wall on Company’s culvert at Ebley. Surveyor and solicitor to Company to view culvert.
Mr Henry Lewis offered to rebuild wall in Spring. Company refused to pay £5 toward expense. Henry Lewis to repair wall forthwith.
Charles Clutterbuck to remove stone and pay tonnage and wharfage at Bristol Road Wharf.
Mr Holbrow, surety of Mr William Purcell.
Mr Mason to receive every week from William Purcell monies collected and pay all to Mr Hawker, chief Clerk.
Mr Hawker proposed Anthony Scott and William Fryer as his sureties.
£250 provided by Mr James Gordon for Mr Mason to be deposited with them as surety.
Mr N S Marling about to succeed Messrs Charles Stephens & Co. at Stanley Mills. Wishes to occupy depot occupied by them at the Ryeford on same terms. Agreed.
Samuel Critchley of Eastington applied to have canal piled and deepened at Eastington Wharf for widening canal. Also piled opposite Organ’s house at Chippenham Platt. Agreed under supervision of Mr Mason.
Mr Hawker’s bonds executed.
Mr Mason deposited note of Mr James Gordon for £250.
Thames and Severn Canal Co request that next stoppage be made in first week of May rather than Whitsuntide agreed. Notice to be given to Messrs T & S Marling to enable them to remove the bridge near Ebley Mill.
T & S Marling asked for leave to introduce a pipe into the canal to supply a pump in their new weaving shops. Refused.
Mr N S Marling agreed to become tenant of land near the Ryeford, at 2s 6d per annum, lately occupied by Messrs C Stevens as a coal wharf.
Messrs Smith & Gyde, tenant of dye houses at Stanley Mill need to land coals free of wharfage. To have land between Mr Marling’s wharf and the road. Small annual rent and expense of making it into wharf.
Three wagon loads of beech or larch poles to be bought for piling.
Present lime kiln to be moved to dock yard at Chippenham Platt.
Barge load of Aberthaw pebbles for burning into lime to be bought.
New parapet wall and coping to be put on Westfield Bridge.
200 feet of elm timber to be bought. Lower bars of lower lock gates of elm instead of oak.
4000 Shropshire bricks and 3000 Frampton bricks to be bought.
Timber for new ice boat to be procured.
Bridge above the Bristol Road might be dispensed with Mr Bengough’s consent.
Embankments near Lockham Bridge separating towing paths from adjoining meadows to be raised to prevent land flood flowing into canal.
Mr Mason to look out site for a house for a clerk near Junction with G&B Canal.
John Burbidge to be clerk at Framilode. Salary £60 per annum. Person to be employed in Burbidge’s place as lock keeper in Double Locks, a mason by trade, and to be employed as a mason in his spare time.
Petition against proposed scheme for Severn Navigation given Company Seal.
Special Meeting. No allowance on tonnage on coals but increased allowance to Mr Biddle on corn and wheat. Drawback of 33½% on tonnage on all wheat on brought into the top level of the Navigation and not carried into the T&S canal, 27% if carried below the short level at Dudbridge, and 6½% ifbelow Double Locks, - per cent below bridge at Eastington.
Application by Messrs T & S Marling for pipe into Navigation referred to solicitor of Company.
Finding an error in the calculation at the last meeting concerning the tonnage to be charged on corn, agreed an amended recommendation to the next General Meeting. 36⅔%, 30% and 12% to be charged.
Mr Mason authorised to purchase a capstan for two pounds.
Thomas Clutterbuck claimed shares nos.118,119, will of Mary Clutterbuck.

Experienced engineer to be employed to survey works of Navigation, particularly mode of supplying it with water.
Resolution of last Half Yearly General Meeting on charging tonnage to be rescinded. Drawback on tonnage of wheat after rates of 36⅔%,on all wheat not carried into T&S Canal, 33⅓% on that brought up into Ebley Level, not into short level at Dudbridge, then rate of 15% above Five Locks not up to Double Locks.
Mr Holbrow to confer with Capt Clegram about the employment of an engineer.
Ordered that the fence across Ryeford wharf be moved to enclose the whole of it.
Instead of charging for each towing boat passing out of the canal at Framilode, ordered that 20 pence be charged for each lock of water used for that purpose.
Special Meeting. Subcommittee to meet Capt. Clegram, inspect works of canal and Capt. Clegram to report on them.

Towing path gates to be erected at Messrs Marling’s Mill to prevent wagons passing to their two gateways.
Geo Basham directed by Mr Mason to repair banks of canal.
Fence to be put up to protect hedge at Stonehouse Wharf.

Wall to be built at the waste weir and a new road made at Organ’s house at Chippenham Platt.

Special Meeting. George James Luke Noble and James Padmore Noble claimed shares nos.181,182,183, wills of Elizabeth Noble and Jane Noble, Taunton.
Proposal to give old part of canal and towing paths above and below Junction to Company of Proprietors of Gloucester & Berkeley Canal, ¾ of an acre, in lieu of piece of land on western side near Junction, about ½ an acre.
Captain Glegram’s report read. Letter to be sent thanking him for the report.
Special Meeting adjourned to next day.
Special Meeting. Mr Wathen, after thanking Captain Glegram, has with Mr Mason looked at the areas of the proposed exchange. Counsel’s opinion to be obtained respecting right of Company to deviated line near Junction and right of Gloucester & Berkeley Canal Co. and this Company to make exchange.
Legal advice to be taken regarding supply of water to canal. Rights of Company at Ebley and Ebley Mills. Mr Croome to act with Mr Wathen.
Special Meeting. William Musty to be appointed lock keeper and mason at Double Locks in place of Thomas Barnfield deceased. 15s per week inclusive of house.
Elisha Oldenham to rent part of Stonehouse Wharf at £40 per annum for 2 years.
Mr Croome produced drafts of cases requested in August. They are to be submitted to counsel.
Mr Mason to procure chain for the crane at Dudbridge Wharf,

Gates erected on towing path near Messrs Marling’s mills to be removed until further order.
Mr Clutterbuck of Dudbridge complained of trespass of Messrs Marling’s work people. Clerk to acknowledge letter and talk to Messrs Marling on the subject.
Special Meeting. Notice to Mr John George to quit dwelling houses, yard, warehouse, stable and garden at Dudbridge.
Wall to be built to support towing path of canal from termination at Wallbridge Wharf to distance corresponding with wall on north side to widen towing path and coal yard on south side.
Mr Mason to see to repair and strengthening crane at Dudbridge Wharf,
Special Meeting. Mr Elisha Oldham, contractor for erection of railway bridge over Navigation at Stonehouse, having erected temporary bridge applied to Committee to sanction same. No objection made until some inconvenience sustained.
A cape to be provided for lock keeper at Double Locks to protect him from weather.
Opinions of counsel on cases relating to the stream at Ebley and the exchange of land read. Consideration to be given at next committee meeting.
£20 subscription to Fund for Relief of Distressed Operatives in parish of Stroud.
Mr George’s clerk, Mr Howells, gave up warehouse on wharf at Dudbridge.
Letter from Mr Denyer, clerk of Thames & Severn Canal Co to Mr Hawker requesting loan of pile driving monkey and crab agreed.
Case and opinion respecting feeding of canal by the stream at Ebley. Company have right to feed. Company to consider any proposal from Messrs Marling but the Company will insist on their strict rights to a perfect supply of water.
Gloucester & Berkeley Canal Co not entitled to sole interest in freehold of diverted line of Navigation and addition to lower level to raise height of water. No exchange unless fee simple obtained.
Application by Framilode Benefit Society of Watermen for permission to use upper lot of warehouse at Framilode for their meeting, and to raise roof when allowed timber and other materials. agreed. Rent of £4 per annum

Half Yearly General Meeting. Tonnage £2786 17s 5d. Balance after wages, etc, £2117 16s 0d. Dividend of £10 10s declared. Proprietors to be informed that last two dividends were increased by temporary transit of large quantity of materials for Great Western, Cirencester & Swindon Railway, and that the lower dividend this time is due to less trade being undertaken following loss of tonnage on 18425 tons.
Question of whether any and what steps be taken to preserve fair share of traffic on Navigation.
Steps to secure power of taking due supply of water at feeder at Ebley.
Special Meeting. Committee willing to consider any proposal from Messrs Marling to secure constant and full supply of water to Navigation in way most convenient to both parties.

Special Meeting. Proposal from Raymond Cripps on building of railway bridge over canal at Stonehouse. Requested consent for stopping Navigation on lower terms than the penalty provided in Act of Parliament. No terms lower than £50 per 24 hour stoppage to be given.

Application to Messrs Osborne Ward, solicitors to Bristol & Gloucester Railway Co to let Stroudwater Navigation Co know whether they are about to proceed to make bridge over Stroudwater Navigation at Stonehouse under powers of Act of Parliament. Unless official communication given on Monday morning next all proceedings on spot to be prevented. No consent to drain under Stroudwater Canal.
Contract with George Basham for keeping towing path in repair not renewed. Labourers under direction of our clerk to be used instead.
Letter from Messrs T & S S Marling stating they were unable to suggest any plan as they were unacquainted with wishes of Committee. Reply that Company are dissatisfied with present mode of feeding water near Ebley Mills. Counsel advice is to restore old dimensions and course of stream to pass under Navigation in its former channel. Works might be suggested by Messrs Marling to secure sufficient supply of water.

Westfield Lock to be repaired.
Mr Mason, estimates for house or shed of stone and timber for ice boat. He is to ask Mr Cambridge of Whitminster House to allow the Company to put ice boat into his boat house for safety.
Bristol Road Bridge to be repaired.
Wall or embankment of stone on bank of brook at Framilode where a slip occurred at last high flood.
Lock side walls at Bristol Road to be repaired and pointed.
Special Meeting. Sketch of intended drain under canal at Stonehouse. Gloucester & Bristol Railway Co. claim right to make it without interference. Mr Mason to watch and inspect drain.
Special Meeting. James Smith of Cirencester proposed to bring 3000 tons of stone, ironwork and timber, along Navigation to works of Gloucester & Bristol Railway at Stonehouse. Tonnage 1s 6d per ton. Drawback of 6d per ton required or it will be less expensive to Railway to bring goods by other means. Agreed on excess of 2000 tons and full tonnage paid.
Letter from Mr Richards, Chairman of Thames & Severn Canal Co requesting reduction of tonnage on brick carriage between Cirencester, Newport and Gloucester. Further information required. Letter to Mr Richards requesting consultation with Mr Denyer of Thames & Severn Canal Co.
Special Meeting. Mr Denyer attended meeting respecting reduction in tonnage. Deputation to meet at Brimscombe on 25 August.
Comparison of lading of vessels called Worcesters. Gauging stick provided erroneous result, 2 tons in 30 less than actual lading. Proper and correct gauging stick to be procured or made.
On all coal delivered below Radcot Bridge on River Thames, or at or beyond Swindon on Wilts & Berks Canal, drawback allowed of 4d per ton on present tonnage of 1s. On all salt delivered at or beyond Newbridge on Thames, beyond Swindon Wharf on Wilts & Berks Canal 4d per ton, present 1s per ton. On manure salt to have drawback to be 6d per ton to these locations.
All slates delivered at Cirencester or beyond 4d per ton on 1s provided Thames & Severn Canal Co lower rates to 2d per ton per mile.
All grain brought from beyond junction of G&B Canal to at or beyond Cirencester to have 4d per ton drawback on 1s.
Other goods with tonnage rate of 1s taken beyond eastern end of T&S Canal to have a 6d per ton drawback providing Thames & Severn Canal Co reduce their tonnage to 1½d per ton per mile. For goods with a tonnage rate of 8d the drawback will be 2d per ton.
William Clark to reside at the top lock at Five Locks as laborer at 13s per week. 1 guinea per annum as lock keeper.
William Daniels and his son to be laborers for 22s per week for both.
Crane at Dudbridge again failed to be repaired. Mr Mason repair, calling in assistance of some engineer.
Drawbacks to be applied once Thames & Severn Canal Co apply reductions provided General Meeting sanctions them.
Gloucester & Bristol Railway Co about to make considerable diversion of towing path at Stonehouse and drain under Navigation. Mr Wathen to remonstrate against inconvenience.
Agreement sought with Mr Eycott to rent his gravel pit for use of Navigation towing path for £10 per annum.
Members of Committee to attend on rotation before meeting to compare tickets with entries on tonnage, cash and other books.

Considered Mr Knapp’s response to Mr Wathen’s letter to Bristol & Goucester Railway Co complaining of their altering the towpath near the Ocean. Subcommittee to view works.
Dam put into Navigation about 28 feet from bank on opposite side of Navigation. Contraction to 18 feet of waterway. Temporary towing path for hauling or drawing vessels over water adjoining old towing path, diverted 40 feet. Interview with Mr Hillier, engineer, agent of Railway Co. Intention to erect south abutment for bridge. Towing path of 8 feet between face of abutment and waterway. Diversion of 22 feet.
Tunnel under Navigation. Works on south side for arching tunnel. Water escaped into tunnel. South end stopped with clay. Violation of provisions of Railway Act.
Diversion of 10 feet permitted by Committee. Erection of new abutment or extension of arch span of bridge to required width or by arms to support arch or head of bridge. No diminishing of minimum height of arch.
Mr Mason to request W S Marling to have key to the Ebley feeder given to them as an experiment two years ago.. Not a hostile act on part of Navigation.
Fixing a day in each month for ordinary committee meetings, also mode in which allowance shall be paid or applied.
Notice to be served on Railway Company. Letter from Mr Wathen to their solicitor. Complaint about deviation in towing path and driving of tunnel under Navigation. Mr Croome to confer with Mr Wathen on notice to prevent Railway Company erecting bridge or putting in south abutment to secure towing path from being diverted, obtaining an injunction if so advised.
Meetings to be held on 3rd Friday of each month. Money for expense of meetings to be divided equally among members.
Unsatisfactory letter from solicitor of Bristol & Gloucester Railway Co.
John Stanton William Henry Stanton and Charles Stanton claimed shares nos.69,114,115,142,143,192, will of William Stanton.
Special Meeting for 16 December to consider independent mode of feeding Navigation with water at or near Ebley.
Special Meeting. Mr Buckland, on behalf of Mr Cripps, contractor for building railway bridge at Stonehouse asked what compensation would be charged for drawing off water for 6 days to lay foundation of the bridge. No consent for bridge in present place. No consent to driving of tunnel.
Mr Wathen read opinion of Mr Cowling on works of Railway Company. Further opinion from an equity barrister.
Notice to Mr John George and other persons to quit house and premises at Dudbridge.
Reductions in tonnage promised by Thames & Severn Canal Co have not been carried into effect. Mr Denyer to be asked to explain.
Mr Mason to be paid for clock bought for use of Company, £10 11s 0d.
Mr Fisher, Mr Wyatt and Mr Croome to see Mr Marling.
Special Meeting. Mr Buckland attended with proposal from Mr Cripps sanctioned by Mr Brunel, chief engineer to Railway Company. Span of bridge to be increased 2 feet, provided ends of timber rest on corbels. Towing path to be reduced by 2 feet, leaving a waterway of 24 feet. Agreed provided not less than 6 feet between waterside of towing path, abutments at least 26 feet, wing walls of towing path built to satisfaction of Navigation Company. Drainage of tunnel only permitted under conditions agreed for bridge in Act of Parliament.
On payment of £150, Clerk may draw off water from Stonehouse Level Monday 26 December to following Saturday night.
Repair in this level and removal of soil near Mr R L Davies’ bridge during stoppage.
Special Meeting. Mr Buckland reported that Mr Hammond, second engineer of Railway Company declared it impossible to increase width of intended bridge by 2 feet. Railway Company would enter into required indemnity against repair, damage, stoppage or leakage on same terms and extent as stated by Act of Parliament. Railway Company to make bridge 30 feet between piers, towing path with good substantial wall, not less than 1 foot thick. Approach of at least 20 yards on each side, furnished with toothing at east end. Payment of £125 instead of £150 for permission to do works.
Resolved that towing path under bridge be reduced to 5 feet. Agreement to 30 feet width of bridge and £125 instead of £150.
No reduction in tonnage on coals by Thames & Severn Canal Co. Necessary to reconsider reduction by Navigation.
Mr Marling’s seen on Wednesday and was taking matter of the feed at Ebley into consideration.
Mr Mason has not been able to see Mr Dyer re tonnage rates.
£125 paid by Mr Buckland. Water let out of Navigation, works of bridge in progress.
Place deepened near Mr R S Davies’ house at Stonehouse to enable two vessels to pass each other.
Letter from Mr Clegram, clerk to Gloucester & Berkeley Canal Co about inconvenience from culverts near Lockham Bridge. One of trunks of culvert broken, violent irruption of water into Navigation. Resolved to restore aqueduct or make another for carrying water of brook or River Froome under Navigation. Accumulation of mud due to acute angle between river and exit from culvert under canal. Mr Mason proposed new culvert of brick and stone instead of wood. Purchase of land from Mr Cambridge obtained on easy terms or gratuituously. Mr Fisher to arrange terms.
Mr Mason to enquire as to cost of iron instead of brick and stonework for culvert near Lockham Bridge.
Special Meeting. New culvert near Lockham Bridge of brick and stonework, two oval passages for water.
Subcommittee received no communication from Messsrs Marling. Response needed before half yearly general meeting.
In case Mr Hawker is rendered wholly incapacitated for his duty as clerk, Mr Cosham to take steps for care and protection of books, papers and property of proprietors.
Mr Samuel Marling willing to subject works of his present mill to powers given to company by Acts of Parliament. Time of shutting hatches not to commence until pond filled sufficiently for water to flow into navigation through feeder. Company to resume control feeder at Ebley. Servants to ascertain by experiment any practical difficulty in keeping up supply of water to Navigation.
Letter from Mr Biddle complaining of stoppage of Navigation. Threat to deduct loss incurred from tonnage. Mr Mason reported that before he made stoppage for works at Lockham Bridge he consulted Mr Biddle’s captain Longney. Vessels not delayed. For time being only passage for vessels drawing 4 feet of water.
Half Yearly General Meeting. Tonnage £3354 0s 11d. Balance after wages, etc, £2626 6s 5d. Dividend of £12 declared.
Dispute between Company and Mr J George referred to Committee.

Offer of Benefit Society of Waterr Men at Framilode to repair the warehouse at Framilode and to construct a room there for £40 accepted. Company to provide £10 worth of timber and other materials. Rent to be 10s per annum.
Special Meeting. Bill in Parliament by Forest of Dean Railway Co for railway from Forest to Gloucester failed before Cmmons Committee. Mr Wyatt to learn views of opposition to proposed railway company, including Thames & Severn Canal Co.
Roberts to be summoned before magistrates for drawing down of Forked Pound Level at or near Whitminster and penalty recovered from him.
John George’s requested empty vessels to be allowed to go up Navigation to Chalford. Price of tonnage to return loaded with stone for use of Severn Improvement Company to enable him to compete with offer of supplying stone from Forest. Granted provided loads of stone pay usual tonnage if Thames & Severn Canal Co do the same.
Appointment of assistant clerk spoken of.
Mr George did not obtain contract for supplying stone.
Letter from Mr Caleb Trotter of Bullo Pill requesting reduction of tonnage on coals brought up to and landed at Junction for exportation, to 1d per ton Framilode to Junction. Gloucester & Berkeley Canal Co. agreed to reduce tonnage from Junction to Sharpness 2d per ton. Request opens up prospect of new trade. Drawback of 2d per ton on coals brought from Framilode to Junction and exported from there.
Junior clerk competent to keep accounts and make himself generally useful to be advertised for at a salary not to exceed £80 per annum.
Annual inspection held on the Company Barge.

Solicitor of Bristol Extension Railway repudiated agreement made by Mr Buckland as to future repairs of Railway Bridge over Navigation near the Ocean. Our solicitor to call on him to carry out agreement.
Mr Wilson, Clerk of Thames & Severn Canal Co, suggested trade on coals to Oxford and vicinity in case drawback made on tonnage of various canals. Offer to reduce their rate to 1s 6d per ton if our tonnage reduced to 6d per ton on all coals through their navigation to or below Eynsham on River Thames. Agreed.
Also agreed with Mr Wilson on a drawback of 6d per ton on timber.
